Privacy Policy

This Privacy Policy (the "Privacy Policy" or "Policy") applies to the software application Mungbean, stylized "mungbean" (the “Application”) as well as the websites and other products and services (collectively, our “Services”) provided by Mungbean Labs, LLC (the “Company”, “we”, "us", or "our"). The Application is a software product relating to a location-based social network.


What information do the Services obtain?

Personal Data. During the signup process, the Application collects Personal Data from you such as your first and last name, date of birth, email, password, phone number, username, timezone, account creation timestamps, information about the manner in which you sign up, user demographics information, and other related information. Other items we may collect and store include your friend list information, profile data (including without limitation, profile descriptions, avatars, preferred colors, roles, privileges, and short tags which may be associated with user content), profile posts chat messages, and content submissions. Since this is a location-based social networking app, the Application does collect information about the location of your mobile device. After login, we collect your location to place you into the appropriate geofenced chat room. Given the nature of a location-based social network, extra care has been taken to obfuscate the location data stored in our systems. The data shown in the Map screen is generated off randomized user locations. We never reveal your exact location to anyone. (However, the premise of the Application is a location-based social network, so other people in the same chat room as you can tell that you are somewhere within the indicated area on the Map screen.)

The location information is collected and saved when you log into the Application with your credentials. After that, your location information is only collected and saved when you press the "update location" button in the Map screen.

User Content. As a user, we collect User Content (including without limitation, chat messages, posts, pictures, videos, links, likes/upvotes, user reports, user preferences, user profile information, viewing activity, viewing preferences, and other related information) that you create, post, upload or otherwise share to the Services. This information may be shared with other users (for example, chat messages are shared with other users in the same chat room as you).

Usage Data. As you use our Services, your usage activity is collected and stored by us. Examples of usage activity include, without limitation, which chat room you are in, the users and their associated data in a chat room, offline/online status, when you use the Application, data regarding what and when you say/post/share and with whom, and interactions with messages/content/notifications from other users.

Analytics information. We use third-party analytics tools to help us measure traffic and usage trends for the Services. These tools collect information sent by your device or our Services, including the web pages you visit, add-ons, and other information that assists us in improving the Service. We collect and use this analytics information with analytics information from other users so that it cannot reasonably be used to identify any particular individual user.

Cookies and similar technologies. When you visit the Services, we may use cookies and similar technologies like authentication tokens, unique identifiers, pixels, web beacons, and local storage to collect information about how you use the Application and provide features to you.

We may ask advertisers or other partners to serve ads or services to your devices, which may use cookies or similar technologies placed by us or the third party.

Log file information. Log file information may be automatically reported by your browser or device each time you make a request to access (i.e., visit) a web page, open a link or picture, use the Application, or do other activities. It can also be provided when the content of the webpage or app is downloaded to your browser or device.

When you use our Services, our servers automatically record certain log file information, which may include (without limitation) your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Service, domain names, landing pages, pages viewed, contents of the request, the identity of the user making the request, and other such information. We may also collect similar information from emails sent to our Users which then help us track which emails are opened and which links are clicked by recipients. We also collect information to help us debug technical issues, such as crash logs. The information allows for more accurate reporting and improvement of the Services.

Device identifiers. When you use a mobile device like a tablet or phone to access our Services, we may access, collect, monitor, store on your device, and/or remotely store one or more “device identifiers.” Device identifiers are small data files or similar data structures stored on or associated with your mobile device, which uniquely identify your mobile device. A device identifier may be data stored in connection with the your user account, user session, device hardware, data stored in connection with the device’s operating system or other software, or data sent to the device by the Company.

A device identifier may deliver information to us or to a third party partner about how you browse and use the Services and may help us or others provide reports or personalized content and ads. Some features of the Services may not function properly if use or availability of device identifiers is impaired or disabled.

Among others we collect the following device identifiers:

  • Platform (e.g. iOS/Android)

  • Device OS Version

  • Application Version

  • Locale information, such as language, region and country

  • Timezone

  • Make and Model

  • Push notification tokens

  • IP addresses

The Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device's unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application.

Metadata. Metadata is additional data that is associated with User Content. For example, Metadata can describe how, when and by whom a piece of User Content was collected and how that content is formatted. Users can add or may have Metadata added to their User Content including a hashtag or other data.

The types of data collected, as described above, may not be exhaustive. We additionally collect the following categories of your personal information and may sell it to third parties: identifiers, commercial information, internet or other electronic network activity information, geolocation data, and inferences drawn from these categories. Some additional data may be collected by integrated SDKs that we use.


How We Use Your Information and Personal Data

In addition to some of the specific uses of information we describe in this Privacy Policy, we may use information that we receive (including Personal Data, User Content, Usage Data, and other data collected from you) for the following purposes:

  • to facilitate the functioning of the features of the Application and/or other Services (for example, creating new chat rooms and sharing messages/content among users in a chat room)

  • to provide personalized content and information to you and others, which could include online ads or other forms of marketing

  • to provide, improve, test, and monitor the effectiveness of our Services

  • to develop and test new products and features

  • to monitor metrics, such as total number of visitors, traffic, and demographic patterns

  • to diagnose or fix technology problems

  • to automatically update the Application on your device

  • to send you notifications, technical notices, updates, security alerts and support and administrative messages

  • to link or combine with information we get from others and/or from you to help understand your needs and provide you with better service

  • disclosure to third parties for interest-based advertising, analytics and market research

  • for any other purposes disclosed to you at the time we collect your data or indicated in this Privacy Policy.

We may access your account to provide technical support, or debug technical issues. Your data may be modified or removed by us for various reasons, such as for supporting new features, removing discontinued features, and database migrations.

To the extent necessary for those purposes, we take all reasonable steps to ensure that your data is reliable for its intended use, accurate, complete, and current.


Sharing of Your Data

We store sensitive user data such as emails, passwords and phone numbers with Firebase, a mobile development platform owned by Google LLC. These companies (and their subprocessors) may have access to user data. The Application uses several analytics frameworks provided by Firebase. Anonymous usage data for debugging, monitoring and feedback is transmitted to Firebase.

We may disclose user data and/or automatically collected information:

  • as required by law, such as to comply with a subpoena, or similar legal process;

  • when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;

  • with our trusted services providers who work on our behalf;

  • If the Application and/or the Company is involved in a merger, acquisition, or sale of all or a portion of its assets. In this case, you will be notified via a notice in the Application and/or the Company's web sites of any change in ownership or uses of your information

We may share your data (including but not limited to, information from cookies, log files, device identifiers, personal data, location data, and usage data) with businesses that are legally part of the same group of companies that we are a part of, or that become part of that group (“Affiliates”). Affiliates may use this information to help provide, understand, and improve the Services (including by providing analytics) and Affiliates’ own services (including by providing you with better and more relevant experiences).

We also share your data as well as information from tools like cookies, log files, device identifiers, User Content, Usage Data, personal data and location data, with third-party organizations that help us provide the Services to you (“Service Providers”). Our Service Providers will be given access to your data as is reasonably and appropriately necessary to provide the Services under reasonable confidentiality and data protection terms. (Examples of the services a Service Provider may provide include storing user-uploaded content, such as pictures, so that other users may access them; or a database service that stores your profile information.)

Our Service Providers include Firebase (a division of Google LLC) and Google LLC. Your data is shared with these companies, and these companies may in turn share your data with their subprocessors. A list of Firebase's subprocessors can be found here, and Google's subprocessors can be found here. We make use of services provided by Google, including Google Ads and Google Analytics. We may use other Service Providers as well, such as Apple, Inc., Amazon, Inc., and DigitalOcean, Inc. Your data may be shared with these Service Providers and their subprocessors. These companies primarily provide cloud infrastructure, storage, analytics, and advertising services.

We may also share certain your data and information such as cookie data with third-party advertising partners. This information would allow third-party ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you.

We may remove parts of data that can identify you and share anonymized data with other parties.

We may also combine your information (including Personal Data) with other information in a way that it is no longer associated with you and share that aggregated information.

You understand that as the Services relate to a location-based social network that is open to the general public, you understand and accept that any information that is collected from you (or is otherwise associated with you) when using the Services may be made publicly available. Your data (including, but not limited to, chat room messages, user content, usage information, and public profile information) may be shared with other users of the Services.


How we Store, Process, and Transfer Your Data

General. The Company is based the United States and the information we collect is governed by U.S. law. Please be advised that U.S. law and laws of other countries may not offer the same protections as the law of your jurisdiction.

To provide you with the Services, we may store, process, and transmit data in the United States and locations around the world, including those outside your country. Data may also be stored locally on the devices you use to access the Services.

Data security. We use reasonable and appropriate information security safeguards to help keep the information collected through the Services secure and take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. However, we cannot ensure the absolute security of any information you transmit to the Services or an absolute guarantee that information on the Services may not be accessed, disclosed, altered, or destroyed. Please understand that there is no ideal technology or measure to maintain 100 % security.

Please do your part to help us. You are responsible for maintaining the secrecy of your unique password, account information, or login credentials, and for controlling access to emails and/or text messages between you and the Company, at all times. Your privacy may also be affected by changes the to any third party service that is used for authentication (for example, your email account). We are not responsible for the functionality, privacy, or security measures of any other organization.

The data stored is not encrypted. The Services do not support end-to-end encryption. The Company and its Service Providers may have access to any content, posts, messages, profile information and other data collected from you. The Services are intended to be a public forum, and should be treated as such.

Data retention. We retain your data on our Services for as long as your account exists or as long as we need it to provide you the Services. You can instruct us to delete your account by emailing us at support@mungbean.io (you will be required to verify you're the owner of the account.). After successful verification, we will initiate deletion of your account within 30 days.

You should be aware that we may retain certain data and other information after your account has been deleted. Some uploads, content, posts or comments you submit may remain visible if and after you delete your account. Some automatically collected data (including but not limited to, logs, analytics data, and usage data) may remain after you delete your account. We are not obligated to remove such data. We reserve the right to use your information in any aggregated data collection after you have terminated your account, however we will ensure that the use of such information will not identify you personally. We will also retain your data as necessary to comply with legal obligations, resolve disputes and enforce our agreements.

Deletion of data in the Application may not necessarily result in deletion of data from our servers. Such data may instead be hidden or archived.

If required by law, you may be entitled to a copy of your information stored on our servers. Please send an email to our Support Team at support@mungbean.io, and include the username for the account along with the request. You will be required to verify the contact information that was used when signing up for the account.

Contacting you. You agree that we may send you Service-related emails (e.g., changes/updates to features of the Services, technical and security notices, and updates to the Privacy Policy).


What are my opt-out rights?

You can stop all collection of information by the Application by uninstalling the Application from your mobile device. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. If you wish to delete your account and wipe all data from our servers (excepting those data described the "Data retention" section above), send a request to support@mungbean.io. You will be required to prove you're the owner of the account, such as by confirming an email address or phone number (via text message) associated with the account.


Children

We do not knowingly collect or solicit any information from anyone under the age of 17. The Services and its content are not directed at children under the age of 17. In the event that we learn that we have collected personal information from a child under age 17 without parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 17, please contact us.


Third Party Web Sites, Content and Services

We are not responsible for the practices employed by any websites, content, or services linked to or from our Services, including the information or content contained within them. This includes any content created, posted, uploaded or otherwise shared by other users of the Services. Please understand that this Privacy Policy applies only to information and data we collect from you.


Changes

This Privacy Policy may be updated from time to time. If we make changes, we will post the updated Privacy Policy and update the "Posted" date above.

We may also attempt to notify you by sending an email notification or text message to the contact information associated with your account (if any) or by sending an in-Application notification, and/or otherwise providing notice through our Services. Unless we say otherwise in our notice, the amended Privacy Policy will be effective immediately and your continued access to and use of our Services after we provide notice will confirm your acceptance of the changes. If you do not agree to the amended Privacy Policy, you must stop accessing and using our Services, and you shall permanently delete all copies of the Application from your device or which otherwise are then in your possession.


Your Consent

By using the Application and/or our other Services, you are consenting to our collection, storage, processing, and other usage of your information as set forth in this Privacy Policy now and as amended by us.
